1. CRITERIA FOR TRIGGERING DON REVIEW: F

  • New hospital construction, capital expenditure development, or addition of beds to an existing hospital
  • Hospital sale/purchase/lease
  • Relocation of health care service(s)
  • DON review is not triggered when there is a hospital closure
  • DON review is not triggered when there is a hospital transfer of control
  • DON review is not triggered when there is a loss of health care service(s)

2. ORGANIZATIONAL STRUCTURE OF REVIEW BOARD & TRANSPARENCY: A

  • DON review is performed by the Public Health Council (PHC)
  • The PHC includes 3 nominees submitted by Health Care For All, 3 nominees submitted by the MA Community Health Worker network among others. (Consumer representatives)

3. REVIEW STANDARDS: F

  • Whether the project is compatible with state health planning goals
  • DON review does not look at whether the project is financially feasible
  • DON review does not look at whether the project has an impact on health care access within a geographic region
  • DON review does not look at whether the project has an impact on underserved populations

4. COMMUNICATIONS WITH THE PUBLIC: B

  • There is a website containing details about the DON process, including summaries of regulations/statues and other relevant information
  • The website contains information about each DON application, including dates of public hearings and information about submitting comments
  • It is difficult for the consumer to find info about the DON process on the website
  • The public is not notified about DON applications via newspaper or another widely circulated platform

5. ACCOUNTABILITY AND PUBLIC ENGAGEMENT: B

  • If requested, a public hearing is held where the public can participate in the review process by testifying
  • The public can participate in the review process by submitting written comments
  • There is not a mandatory public hearing where the public can testify
  • There is not a regularly scheduled review board meeting where the public can testify

6. POST-APPROVAL REVIEW AND ENFORCEMENT: B

  • After a DON is approved, there is a mechanism in place for enforcing compliance with DON requirements and restrictions
  • There is not a post-approval challenge process
