1. CRITERIA FOR TRIGGERING CON REVIEW: F

  • New hospital construction, capital expenditure development, or addition of beds to an existing hospital
  • CON review is not triggered when there is a hospital closure
  • CON review is not triggered when there is a hospital sale/purchase/lease
  • CON review is not triggered when there is a hospital transfer of control
  • CON review is not triggered when there is a loss of health care service(s)
  • CON review is not triggered when there is a relocation of health care service(s)

2. ORGANIZATIONAL STRUCTURE OF REVIEW BOARD & TRANSPARENCY: C

  • The health department staff reviews applications and the commissioner makes final decisions
  • Alaska does not have an appointed board to review CON applications
  • There is no requirement for consumer representation on the review body

3. REVIEW STANDARDS: a

  • Whether the project is compatible with state health planning goals
  • Whether the project will impact underserved populations
  • Whether the project will impact access within a geographic region
  • CON review does not look at whether the project is financially feasible

4. COMMUNICATIONS WITH THE PUBLIC: A

  • There is a website containing details about the CON process, including summaries of regulations/statutes and other relevant information
  • It is easy for the consumer to obtain info about the CON process on the website
  • The website contains information about each CON application, including dates of public hearings and information about submitting comments
  • The public is notified about CON applications via newspaper or another widely circulated platform

5. ACCOUNTABILITY AND PUBLIC ENGAGEMENT: a

  • The public can participate in the review process by submitting written comments
  • A mandatory public hearing is held where the public can participate in the review process by testifying
  • There is not a regularly scheduled review board meeting where the public can participate by testifying

6. POST-APPROVAL REVIEW AND ENFORCEMENT: A

  • After a CON is denied, there is a post-approval challenge process
  • After a CON is approved, there is a mechanism in place for enforcing compliance with CON requirements and restrictions
